New Laws in Effect Relating to Annual State Housing Element Reporting

January 1, several new laws went into effect that make changes to Annual Housing Element reporting.

These laws are:

  • AB 2094—which requires that annual reports include data that shows a jurisdiction’s progress in meeting the housing needs of extremely low-income families (those earning 30% of Area Median Income and below).
  • AB 2339—which, among other changes, requires sites identified in local housing elements for the development of emergency shelters, transitional facilities, and permanent supportive housing be located in residential and mixed-use areas and near services. The law also requires that any standards applied to emergency shelter development be objective.
  • AB 2653—which expands the reporting requirements to include a number of new data points, including the number of new housing units constructed and demolished, the number of homes that are for-sale or for rent, the number of approved developments that used State Density Bonus Law or AB 2011, and whether development applications were subject to a ministerial or discretionary approval process.
